We Need Laws to Allow Borrowing of Designs and Innovations From China For US Citizens

Anyone who manufactures anything in the United States, and all the innovators and inventors know that if they come up with a new product and start producing it, even if they have a patent, it will be copied by someone in China, it will be mass produced, and it will be sold all over the world for much cheaper than they can afford to produce it for. At some point this disincentive for innovators and inventors will cause fewer innovations and inventions to come forth in the United States.

For those who think that America will do all the designing, creating, and innovations, and China will be the factory floor to produce at all, they seriously haven’t thought out the situation as it is currently playing out. Back in 2002, I went to the SEMA and APEX tradeshows for the automotive industry. At the APEX Show that year, there were at least four football fields full of booths, 10 X 10, with nothing but Chinese and Asian knockoff parts, copies, and patent infringements.

Indeed, I was blown away when I asked one of the individuals who sold fake Ford car parts, and also had what looked like Coleman lanterns, the same green color, also for sale in his booth, looking for US distributors to market and wholesale them too – I said to the gentleman in the booth; hey, that’s a Coleman lantern, and those are Ford car parts, and he told me they weren’t. I said; yes, they are. And he swore to me that they were not, he then told me that; I know for a fact those are ‘NOT’ Ford or Coleman’s, because my brother has contracts with both of those companies, and those factories are next door to mine.

US Inventors and Innovators Depressed Over Patent Violations – Who Wouldn’t Be

Not long ago, I was talking with an inventor, and he wanted to bring his invention to market, but was worried that someone in China would steal his invention and then mass produce it leaving him holding the bag. As we got to talking about this reality and real challenge in the field of innovative inventions and international patent law he made an interesting statement, when he said;

At some point you have to stop worrying about your patent being copied, and go do it. Indeed, I agree, and yet, the thing that I think upsets me, is that in many cases it is Taiwanese, Hong Kongers, or even US billionaires, or no-nation billionaires purposely stealing the ideas and then setting up factories in China to mass produce them and then sell them around the world.

Intellectual property is a tough one. Recently, I noted that Brazil demanded that we backtrack on a certain tariff or they’d place 105 products on tariff, and bust those patents. Meaning they would produce those items and sell them to themselves and the rest of the world So, when people point to International Patent Courts, WTO, and trade agreements, you never know what’s going to happen.

Such as Bolivia stealing the water treatment facilities in Bolivia from an American Company, or Venezuela nationalizing foreign owned grocery stores, stealing oil services equipment or taking Conoco-Philips and Chevron for a ride and nationalizing their oil industry right after upgrades are completed. And to think we have supported all these nations in the past, and helped them come up in the world, only to get the shaft
